Planning Commission to hear A&B’s Waiale project

Two major items will be considered at the Maui Planning Commission meeting this Tuesday, Nov. 24th, at 9 am. PLEASE COME AND TESTIFY (see location below).

Agenda Item D. 1  Bill to amend Ch 2.80B MCC regarding Community plans and  zoning
Once again, the Planning Director is trying to let Zoning trump our Community Plans.

Hawaii State law (HRS 46-4) says that Zoning must conform to the Community Plans, and shall be used to put them into effect. Thousands of hours and millions of dollars have been invested to create our Community Plans. PC-21 would overturn the will of the people, and would violate Hawaii state law.  This will result in lawsuits that would cost Maui County millions of dollars to defend against.

Comprehensive Zoning (MCC 19.04) was adopted in 1960, but after 55 years has not been fully implemented throughout Maui County. Amendment of Community Plan designations has taken place multiple times without changing the underlying Zoning to be consistent. This has created many conflicts. Others have been created by the Planning Director, who continues to approve permits that are not in compliance with the Community Plans.

Ask the Maui Planning Commission to:

1. Reject PC-21.
2. Tell the Planning Director to:
   1.  finish implementing the Comprehensive Zoning Code.
   2. Eliminate Stacked Zoning during Community Plan updates, as recommended by the Planning Director in 2009.
   3. Update each Community Plan to specify which Zoning Districts correspond with Community Plan Designations.

Agenda Item C.2. Wai’ale Change in Zoning/ Community Plan Amendment/ Project District, Phase I

Talking points:

• 75% of this 950 unit project: (consisting of 300 single family and 650 multifamily units) will not be affordable to local families, yet is is being described as “providing housing for Maui’s families.”  Only 225 of the units will sell between $300K and $570k.  The other 725 can be any price.

• the Wai`ale development plan map is not what was shown to the State Land Use Commission.

• that map had a 22 acre park along Waikapu stream. This one has half that size and does not indicate an appropriate buffer along at least half the stream.

• Archaelogical review consisted of one 15′ x 2 ft wide trench for every 2 acres. 10 acres of the property was never even surveyed.  The soils is very sandy. Burials have recently been found just across the Waikapu stream on land the county purchased for its baseyard. More complete archaeological review is needed.

The project should be done right. Ask the Planning Commission to recommend review by the Cultural Resources Commission and restoration of the original proposed park before they recommend approval of this proposed plan.
